[وَقُلْ جَاءَ الْحَقُّ وَزَهَقَ الْبَاطِلُ إِنَّ الْبَاطِلَ كَانَ زَهُوقاً]

Al-Shawak Court Acquits Hizb ut Tahrir Member Nasr al-Din

Today, Wednesday, 22 Safar al-Khayr 1448 AH, corresponding to 5 August 2026 CE, a trial session was held for Hizb ut Tahrir member Brother Nasr al-Din Muhammad Adam Thamin, in Case No. 1057, under Article 25 of the Cybercrimes Act, which states: “Whoever prepares or uses the information and communications network, or any information media or applications, to defame the reputation of any person shall be punished with imprisonment for a period not exceeding three years, flogging, or both.” This was after Article 69, under which the case was originally filed, had been dropped.

After the court heard the investigating officer and Brother Nasr al-Din’s lawyer questioned him, it became clear that Brother Nasr al-Din’s post, which was the subject of the case, had not insulted any particular person, whether the intelligence services or any other official bodies.

The judge then asked Brother Nasr al-Din about his intention behind the post. He explained his intention in three points:

First: He said that there is neither security nor safety except through obedience to the Most Merciful and under the Islamic state. He then asked whether there was any problem with that. If there was a problem, then the matter was serious.

Second: The problem of drugs will not be solved by man-made laws, but rather by the deterrent rulings of Islam.

Third: He carried out this action as an act of commanding what is right and forbidding what is wrong, in response to the saying of the Messenger of Allah (saw):

«لَتَأْمُرُنَّ بِالْمَعْرُوفِ وَلَتَنْهَوُنَّ عَنِ الْمُنْكَرِ، أَوْ لَيُوشِكَنَّ اللَّهُ أَنْ يَبْعَثَ عَلَيْكُمْ عِقَاباً مِنْهُ، ثُمَّ تَدْعُونَهُ فَلَا يُسْتَجَابُ لَكُمْ»

“You must command what is right and forbid what is wrong, or Allah will soon send upon you a punishment from Him, and then you will call upon Him, but your supplication will not be answered.”

The session was then adjourned for the Dhuhr prayer, and Brother Nasr al-Din led the people in prayer as imam.

After the court reconvened to pronounce the verdict, the judge read the following ruling: “This speech has nothing to do with Article 25. The article concerns defamation and accusations against specific individuals. In his post, he spoke about a general attribute and did not intend any particular authority or person. He is an activist working to establish the Khilafah and implement Islam. This is an intellectual opinion and an intellectual viewpoint, and it has nothing to do with Article 25. Every group has its opinions and ideas, and everyone writes on the internet and social media... There is no legal provision applicable to this post. Therefore, the court rules that the accused is acquitted.”

We in Hizb ut Tahrir / Wilayah Sudan, while congratulating Brother Nasr al-Din on his release, say: Praise be to Allah. The truth has come and falsehood has vanished; indeed, falsehood is bound to vanish.
